CAP’s and RAP’s are ready to GO!

With the commencement of CAP’s and RAP’s on 1 October 2017, the new Assessment Panel Members – Code of Conduct was adopted by the Minister for Planning and corresponding regulations in the Planning, Development and Infrastructure (General) Regulations 2017 are in operation. Both documents can be accessed through the SA Planning Portal.

As previously reported, Panel members and Council staff should note that the new Code of Conduct contains stricter conflict of interest provisions than those contained within the PDI Act as well as provisions preventing Panel members from engaging in conduct which may benefit an applicant or representor or which may give rise to a reasonable presumption that they have prejudged a development proposal or application.  These provisions, as well as many others within the new Code are taken directly from the Development Act and the previous Minister’s Code of Conduct under section 21A of that Act and should, therefore, be familiar to Council staff and to many Panel members.
