An Update on the State Planning Commission’s Draft Planning and Design Code — Update Report

Following our most recent Alert and a number of questions from our clients, feedback from the State Planning Commission has clarified the following:

1.    submissions received on the draft Phase 2 Code are being carefully considered with the Commission recommending amendments to the Minister that address this feedback;

2.   in addition, the Phase 2 Code is being refined to ensure that discrepancies in the version of the Code released for consultation are addressed prior to its implementation; and

3.   the Update Report addresses Phase 3 Code amendments only, due to the public consultation timeframes and the nature of refinements to be made to this version of the Code.

We look forward to progress on the implementation of Phase 2 of the Code and the final version ahead of its implementation in a few months’ time. We trust that this update helps clarify the status of the draft Phase 2 Code.
