It is now commonplace for council officers and development consultants to undertake the early stages of appeals and other ERD Court matters.  Doing so, in appropriate circumstances can result in positive outcomes whilst saving on legal expenditure.

As a result of the operation of the PDI Act, new  Rules, forms and technological advancements, new legal and practical challenges have arisen for relevant authorities, appellants, councils and other decision-makers.

These challenges must be carefully considered in determining whether legal representation is required from the outset.

Further, many ‘standard’ practices adopted by councils and consultants are now outdated and in need of revision.

Kelledy Jones Lawyers is pleased to offer two (2) seminars on current ERD Court practices and procedures for development professionals who interact with the ERD Court.

These sessions will provide attendees with the confidence to determine when and how legal representation is required, how to prepare Court documents as now required by the ERD Court and the relevant rules and etiquette of Court attendances.  The sessions are suitable for officers, team leaders, managers and more senior personnel, whether or not they have prior experience in the ERD Court.

Session 1 is for planning professionals and addresses:

  • the various forms of appeals and reviews concerning planning assessment decisions available under the PDI Act;
  • factors to consider when determining when and how to engage legal representation;
  • ERD Court rules and forms;
  • using the CourtSA portal;
  • communications with the Court and other parties;
  • ERD Court etiquette and expectations;
  • costs under the Environment, Resources and Development Court Act 1993;
  • case law update.

Session 2 is for building surveyors and development compliance officers and covers:

  • building appeals and appeals against orders and notices issued under the PDI Act;
  • factors to consider when determining when and how to engage legal representation;
  • ERD Court rules and forms;
  • using the CourtSA portal;
  • communications with the Court and other parties;
  • ERD Court etiquette and expectations;
  • costs orders and their implications;
  • case law update.

Each Session will provide accredited professional attendees with 1 unit in legislative compliance and 2 general units for Accreditation Scheme CPD purposes.

Both Sessions will be held at Rydges South Park Adelaide.  Session 1, on Thursday 27 October  2022 from 9.00am – 1.00pm (SOLD OUT) and Session 2 on Friday 28 October 2022 from 9.00am – 1.00pm.  Morning Tea and Lunch is provided.

Both sessions are also available online. Session 1, on Tuesday 25 October 2022  from 9.30am – 12.30pm and Session 2 from 2.00pm – 5.00pm.

Pricing:

$225 + GST per person for a single Session and $300 + GST for both Sessions.
